A person who becomes a Tribe member or Tribe financial member will be bound by the membership terms and conditions below as varied from time to time. Gerard Lighting reserves the right to vary the terms and conditions at any time and without notice. Please check these terms and conditions at regular intervals for any changes.
Definitions:
- Tribe – means the Gerard Lighting Loyalty program
- Tribe Financial Member – an owner, manager or director of an electrical contracting business may become a Tribe financial member. Tribe financial members are entitled to the same benefits as Tribe members; however will receive additional financial benefits. Tribe financial member’s everyday purchases of selected Pierlite, Crompton and Sylvania products will be rewarded (subject to these terms and conditions).
- Tribe Member – Employed licensed electrical contractors may become a Tribe member if their employer is a Tribe financial member. Applicants must have obtained a registration code from their employer to register
- Tribe Products – means eligible Gerard Lighting products selected for the Tribe. Selected Tribe products will come from Pierlite, Crompton and Sylvania product ranges and will vary from time to time
- Gerard Lighting – means Gerard Lighting Pty Ltd, ABN 94 122 520 307
- Website – means www.gerardtribe.com
- The singular includes the plural and vice versa
1. Tribe Member:
All licensed electrical contractors have the opportunity to join the Tribe. You must be a licensed electrical contractor and provide an email address. The owner, manager or director of the electrical contracting business employing the electrical contractor must join the Tribe first as a Tribe financial member and provide their employees with a registration code in order for employees to become Tribe members. The registration code will be provided to the owner, manager or director of a licensed electrical contracting business upon successful registration as a Tribe financial member. It is the Tribe financial member’s responsibility to notify their employees of the registration code in order for them to become Tribe members.
The acceptance or rejection of a membership application will be determined by Gerard Lighting in its absolute discretion.
1.1 Becoming a Tribe member -
All licensed electrical contractors employed by a Tribe financial member have the opportunity to join as Tribe members. Applicants must complete the following process and have obtained a registration code from their employer. If their employer is not registered as a Tribe financial member and has not obtained a registration code for their employees to become Tribe members, employees are not eligible to register as Tribe members.
In order to register as a Tribe member the applicant must follow the below process:
- Complete the online application process on the Website
- follow the prompts provided by the ‘Join’ icon
- select ‘I am a staff member of an licensed electrical contractor’
- populate all mandatory fields to successfully join
- read and accept all terms and conditions
- Membership is for a 12 month period and Gerard Lighting has the right to cancel any membership subject to these terms and conditions without compensation
- Membership cost is $50.00 GST exclusive for 12 months
- Payment options are online only via credit card or debit card
- Upon successful payment a notification email will be sent confirming registration as a Tribe member.
1.2 Once registered -
Once registered Tribe members will receive a welcome pack as a personal thank you for supporting the Tribe. The welcome pack will contain a membership card, welcome letter, Tribe hat, Tribe car sticker, Tribe shirt and a member booklet.
2. Tribe Financial Member:
To register as a Tribe financial member, you must be an owner, manager or director of an electrical contracting business. Tribe financial members are entitled to the same benefits as Tribe members however they will receive additional financial benefits.
The acceptance or rejection of a membership application will be determined by Gerard Lighting in its absolute discretion.
2.1 Becoming a Tribe financial member -
In order to register as a Tribe financial member the applicant must follow the below process:
- Complete the online application process on the Website
- follow the prompts provided by the ‘Join’ icon
- select ‘I am an electrical contractor business owner’ option
- populate all mandatory fields to successfully join
- read and accept all terms and conditions
- Membership is for a 12 month period and Gerard Lighting has the right to cancel any membership subject to these terms and conditions without compensation
- Membership cost is $50.00 GST exclusive for 12 months
- Payment options are online only via credit card or debit card
- Upon successful payment a notification email will be sent containing
- Tribe financial member’s user name and password to log in to Website
- a registration code: to be passed onto licensed electrical contractor employees who wish to become Tribe members
2.2 Once registered -
Once registered Tribe financial members will receive a welcome pack as a personal thank you for supporting the Tribe. The welcome pack will contain a membership card, welcome letter, Tribe hat, Tribe car sticker, Tribe shirt and member booklet.
2.3 If electrical contracting business owners are in a partnership -
Owners of an electrical contracting business who are in partnership are entitled to register one partner as the Tribe financial member and the other partner(s) will be registered as a Tribe member(s).
2.4 Becoming a Tribe financial member if you are in a partnership -
- Visit the Website click ‘Join’ icon, select ‘I am an electrical contractor business owner in a partnership’ and follow the prompts
- one partner is to register and include the other partner(s) details. The other partner(s) will receive an email with a hyperlink for them to click on and confirm their details
- populate all mandatory fields to successfully join
- read and accept all terms and conditions
- Both partners will have individual membership cards sent to them in the welcome packs
- Each membership is for a 12 month period and Gerard Lighting has the right to cancel any membership subject to these terms and conditions without compensation
- Each membership cost is $50.00 GST exclusive for 12 months
- Payment options are online only via credit card or debit card
- Upon successful payment a notification email will be sent to all partners, however the first partner’s notification email will contain the following additional details as he/she will become the Tribe financial member:
- Tribe financial members’ user name and password to log in to Website
- a registration code: to be passed onto licensed electrical contracting employees who wish to become Tribe members
2.5 Once registered -
Registered Tribe financial members in a partnership will receive a welcome pack for themselves and each partnership Tribe member as a personal thank you for supporting the Tribe. The welcome pack will contain a membership card, welcome letter, Tribe hat, Tribe car sticker, Tribe shirt and member booklet.
3. Termination Of Membership:
Gerard Lighting may terminate the membership of a Tribe member or Tribe financial member without notice for any reason including, without limitation, if the Tribe member or Tribe financial member:
- Fails to comply with these terms and conditions
- Abuses any privilege afforded to the Tribe member or Tribe financial member under the Tribe
- Supplies any misleading information or makes any misrepresentations to Gerard Lighting or its agents in connection with the Tribe
- If a Tribe Member ceases their employment as a licensed electrical contractor or dies
- If a Tribe financial member ceases to be an electrical contractor who is an owner, manager, director, partner or employee of an electrical contracting business or dies.
A Tribe member or Tribe financial member may terminate their participation in the Tribe at any time by giving written notice to Gerard Lighting at info@gerardtribe.com
Gerard Lighting may suspend or terminate the Tribe at any time at its discretion without prior notice.
4. Training Opportunities:
One of the main focuses of the Tribe is to ensure all licensed electrical contractors have the opportunity to be invited to social events, business networking functions, and product and training nights.
5. Promotions & Events:
There will be several events and promotions held each year for Tribe members and Tribe financial members to become involved in. These events will be based around networking, building relationships, gaining product knowledge and building brand loyalty.
The Tribe will offer Tribe members and Tribe financial members the chance to receive exclusive benefits and rewards for being a Tribe member or a Tribe financial member.
6. Privacy & Collection Statement:
In keeping with the provisions of the Commonwealth Privacy Act 1998 (Privacy Act) and the National Privacy Principles, Gerard Lighting is committed to an individual’s right to keep personal information private.
Following is the information that Gerard Lighting is required to communicate to all Tribe participants. Applicants are advised to read this Statement to understand the Privacy Policy. By joining the Tribe, Tribe members and Tribe financial members authorise Gerard Lighting to collect, use and disclose their personal information in accordance with this Statement and the Privacy Policy. A full version of the Privacy Policy can be found on the Website.
6.1 The personal information we collect -
Gerard Lighting will only collect information relevant to the management and operations of the Tribe. The information collected will include contact details of Tribe members and Tribe financial members, personal details and information about member activity on the Website and in the Tribe.
We will collect this information directly from the Website (including the online application forms) and via online competitions.
We will not collect any sensitive personal information, such as that relating to health issues, unless this is necessary to provide Tribe members or Tribe financial members with a specific reward or service and then only with their consent.
Gerard Lighting may be unable to provide the information, products or services a member requests, or allow a member to participate in competitions or promotions, if Gerard Lighting is not given the information it has requested.
6.2 How we use your information -
Tribe members or Tribe financial member’s personal information may be used to:
- Send invitations to Tribe events, information about competitions and promotions and communications about Tribe Products and services
- Administer and manage the rewards and services
- Research and develop the Website and the Tribe, including compiling reports, dispatch of rewards and program development.
If you do not wish to receive invitations to Tribe events, teasers, competition information or regular promotional communications from the Tribe (including new Tribe Product releases and specials etc) then please use the 'Contact Us' page on the Website to notify Gerard Lighting of this request.
6.3 Others who may access personal information -
Personal information collected by Gerard Lighting will not be shared, sold or traded to any party not included in the operations of the Website or the Tribe.
Gerard Lighting does provide personal information to select outsourced service providers that perform certain functions or operations of the Tribe.
Outsourced service providers may include:
- Providers assisting with the administration of the Tribe
- Reward providers
- Information technology services
- Delivery or courier companies.
Gerard Lighting ensures that these outsourced service providers are bound by obligations of confidentiality and may only access personal information to the extent necessary to provide the services required.
6.4 Your information is secure -
Gerard Lighting will use up-to-date techniques and processes that meet current industry standards to ensure personal information is kept secure and confidential and is protected from loss, misuse or unauthorised access, disclosure or modification.
Only personnel employed by Gerard Lighting and those outsourced service providers who perform services on its behalf, and are authorised to handle Tribe member or Tribe financial member’s information, will have access to personal information.
Gerard Lighting will not retain any personal information of any Tribe member or Tribe financial member for any longer than is required to administer the member’s participation in the Tribe.
6.5 Internet privacy -
Gerard Lighting realises that when accessing the Website and interacting with the Tribe online, it needs to further provide assurance that personal information is secure.
There are many sections of the Website that can be accessed anonymously. However, where personal information is collected it is passed through a secure server using encryption technology which scrambles the information to ensure it is protected over the internet.
Stored information is further protected from unauthorised access through the use of multiple firewalls, secure passwords and sign in processes.
6.6 Help us to ensure we hold accurate information -
Gerard Lighting will take all reasonable steps to ensure that the personal information that is collected, used and disclosed is accurate, complete and up-to-date. However the accuracy of that information depends on the information that members provide. Gerard Lighting recommends that Tribe members and Tribe financial members update the 'Member Dashboard' section of the Website should any of their personal information change. Please let Gerard Lighting know if there are any errors in your personal information, or you can amend the error by updating the 'Member Dashboard' page.
6.7 Members access to personal information -
Tribe members and Tribe financial members have a right to access their personal information, subject to some exceptions required by law. To do so, please let Gerard Lighting know. Members may be required to put their request in writing for security reasons.
Gerard Lighting’s objective is to respond to any complaint and where personal information of a member is incorrect, take all reasonable action to ensure that it does not happen again.

7. Tax Liability:
Tribe members and Tribe financial members should seek their own independent tax advice in respect to any benefits received in relation to their status as a Tribe member or Tribe financial member and any tax liability may vary depending on the their individual circumstances.
Any tax, liability or duty arising from a Tribe member or Tribe financial member’s participation in the Tribe is the responsibility of the member.
8. Limitation On Liability:
All conditions and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Tribe are expressly excluded to the full extent permitted by law.
Any liability Gerard Lighting may have to a Tribe financial member under statute in respect of such goods or services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again or repairing, or repaying the costs of repairing the goods, at Gerard Lighting’s option.
No granting of time indulgence or failure to enforce a provision of these terms and conditions shall constitute a waiver by Gerard Lighting of the same.
9. Disclaimer:
Gerard Lighting:
- makes no express or implied warranty or representation in connection with the rewards (including with respect of type, quality, standard of fitness for any purpose);
- makes no guarantee in relation to access to the Website and shall not be responsible for the service or network being interrupted, timely or error free.
10. Severability:
If any part or all of any provision of these terms and conditions becomes or is found to illegal or unenforceable that provision may be severed from these terms and conditions and the remaining provisions of these terms and conditions shall continue in force.
11. Governing Law:
These terms and conditions will be construed according to and governed by the law of South Australia, Australia. The parties submit to the exclusive jurisdiction of the courts in and of South Australia in relation to any dispute arising under these terms and conditions.
There will be several events and promotions held each year for Gerard Tribe members to become involved. These events will be based around networking, building relationships, gaining product knowledge and building brand loyalty. The Gerard Tribe will offer members exclusive benefits and rewards for purchasing Gerard Tribe products.
